Terms of Service

Prices are listed in US dollars on the product page at the time of purchase. We may adjust prices, run promotions, or offer volume discounts at any time, but the price at checkout is the price you pay for that order.

Payments are processed by Stripe. We do not see or store your full card number. By submitting payment information, you authorize the charge of the order total to the payment method you select. Successful payment triggers immediate digital delivery of the purchased lists to the email address you provide at checkout.

Applicable sales tax, if any, will be calculated and displayed at checkout.

When you purchase a mailing list, we grant you a perpetual, worldwide, non-exclusive, non-transferable license to use that list for your own direct-mail campaigns. There is no expiration, no per-mail fee, and no usage tracking. You may mail to the addresses as often as you wish, for as long as you wish, in service of your own business or organization.

You may not, however:

• Resell, sublicense, redistribute, or republish a purchased list (in whole or substantial part) to any third party.
• Share or grant access to the list to anyone outside your organization.
• Use a list to build a derivative dataset, directory, or mailing-list product that competes with ours.
• Combine a list with personally identifying tenant data obtained from other sources for purposes that violate the law (see Section 6).

For 30 days after purchase, you may re-download a list up to five times from your account page. After that window, additional re-downloads are available on request — just contact us.

Every address in every list passes USPS Delivery Point Validation (DPV) before it ships, and each catalog list is re-verified at least every 60 days. In normal practice this produces deliverability rates of 97–99% on freshly purchased lists.

We do not, however, guarantee deliverability of any individual address or of a list as a whole. Real-world deliverability is affected by tenant turnover, building renumbering, USPS database lag, and factors entirely outside our control. A small percentage of returned mail ("Address Unknown", "No Such Number", etc.) is normal and expected for any direct-mail campaign.

We make no representation or warranty about response rates, conversion rates, or any other business outcome you may seek from a mailing campaign.

You agree to use lists purchased from us only for lawful direct-mail and marketing purposes that comply with all applicable federal, state, and local laws, including but not limited to:

• The CAN-SPAM Act (for any companion email follow-up), the Telephone Consumer Protection Act (TCPA), and applicable state direct-marketing statutes;
• USPS rules for bulk mail, saturation mail, and Every Door Direct Mail (EDDM) campaigns;
• Fair Housing laws — you must not use a list to discriminate in housing-related advertising on the basis of race, color, religion, national origin, sex, familial status, or disability;
• Consumer-protection and anti-fraud laws.

You agree not to use a list to:

• Send threatening, harassing, defamatory, obscene, or fraudulent mail;
• Promote illegal goods or services;
• Stalk, surveil, or otherwise target an individual or household for harm;
• Solicit minors;
• Send mail that misrepresents the sender, including disguised commercial mail and look-alike government solicitations.

Violation of this section may result in immediate termination of your account, denial of future orders, and (where laws are broken) referral to the appropriate authorities. You are solely responsible for the content of mail you send and for compliance with all applicable laws in the jurisdictions where you mail.

Because each list is delivered instantly as a digital file, we do not offer routine refunds after the file has been delivered to the email on the order.

If the list you received is materially wrong — the wrong building, significantly fewer verified units than the product page promised, or files that are corrupt or unopenable — contact us at [email protected] within seven (7) days of purchase. We will either supply a corrected list at no charge or refund the order, at our discretion.

Bounce-back rates that fall within normal direct-mail expectations (see Section 5) are not eligible for refund.

The Service, including the software that runs it, the catalog organization, the website content, our trademarks ("Apartment Mailer", our logo), and the curated arrangement of mailing data, is owned by us and protected by US and international intellectual-property laws.

Your license to a purchased list is described in Section 4. Nothing in these Terms grants you any right to our trademarks, software, or proprietary methodology.

We may suspend or terminate your access to the Service, refuse a future purchase, or revoke your license to a previously purchased list if we have reasonable grounds to believe you have violated these Terms, particularly Section 6 (Acceptable Use). Where practical we will give you notice and a chance to cure, but for serious or repeated violations we may act without prior notice.

You may terminate your account at any time by contacting us. Termination does not entitle you to a refund of past purchases except as set out in Section 7.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Service will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.

Before filing any formal legal action, you agree to first attempt in good faith to resolve the dispute by contacting us at [email protected] and giving us at least 30 days to respond.

These Terms, together with our Privacy Policy and any order-specific terms presented at checkout, constitute the entire agreement between you and us regarding the Service. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

You may not assign these Terms or transfer your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of our assets.
